THIS AKITA IS BEING SOLD AS A POTENTIAL SHOW AND
BREEDING QUALITY ANIMAL.
For the

Special conditions and or
arrangements affecting this sale:
I guarantee this Akita
to the best of my knowledge to be of sound body, good health and free of any
communicable disease at the time of sale/placement. Client has three working days from the date
on this contract to have this Akita
examined by a licensed veterinarian.
Should any serious illness be found at that time, upon written
certification from the veterinarian, the Akita
may be returned for a full refund of the purchase price (the amount of cash
actually paid by the Client to the Seller for the dog.) or a replacement.
This Akita
is guaranteed to be free of any disqualifying faults named by the AKC. This guarantee shall also cover hip
dysplasia, knee and elbow dysplasia, thyroid disorders and progressive retinal
atrophy, (PRA). As long as this Akita
stays with the client and the prefix “REDBONE” is used on the AKC registration
papers, this Akita will be
guaranteed until the age of 30 months.
Any of these faults must be of genetic origin and not be the result of
environmental factors, poor nutrition, accidents or illness incurred after the
Client has taken possession. If one of
these faults should develop, upon written certification by a veterinarian and
proof that the Akita has been
sterilized, Seller shall replace the Akita
with another show and breeding potential animal when available. Tests for genetic diseases must be performed
before the Akita is used for
breeding purposes. If
a breeding occurs prior to this, accidental or not, all guarantees are null and
void.
In case of hip dysplasia,
replacement will be made solely under the following conditions: At 24 months of age this Akita
shall be x-rayed by a competent veterinarian in a form acceptable to OFA. If OFA declares the animal dysplastic, Client
shall submit proof of this finding to Seller.
If said x-ray is not submitted to OFA, but Client’s veterinarian
declares the Akita dysplastic,
Client shall submit to Seller a copy of the Akita’s
x-ray within 30 days of its date. If
both Client’s veterinarian and Seller’s veterinarian agree that the x-ray is in
proper form and indisputably shows the Akita
to have hip dysplasia, not traumatic, then this shall be accepted as a
substitute for the required OFA finding.
Client shall have Akita
sterilized prior to receiving a replacement.
Client agrees that this Akita
must be enrolled and complete at least a 6-week puppy training class, and basic obedience class by the age of 8
months. Socialization and training is
imperative to this Akita’s well
being, as is companionship with his/her new owners.

Client agrees to provide regular
veterinary care, proper food, clean fresh water, shelter, a securely fenced
yard of at least 5 ft. and a kennel run.
This Akita shall not be
allowed to run loose off lead outside such.

Client understands that this Akita
is being purchased as a potential show and breeding animal. Client agrees to act as insurer in this
respect by following Seller’s instructions on diet, training, instruction and
grooming. Client shall offer this Akita
every opportunity of success in the show ring through proper conditioning and
presentation, including the possible services of a Professional Handler if deemed necessary by Seller.

Client understands and agrees
that this Akita, if a bitch, shall
not be serviced, accidentally or not, by a stud before she attains the age of
24 months and has had all genetic health testing completed. This Akita
shall only be bred to another Akita
of Show/breeding quality, i.e. at least AKC major pointed, OFA certified, and
eye certified. No progeny of this Akita
shall be sold, given, or transferred to pet shops, litter lots, to persons
contemplating breeding for sale to commercial distributors of dogs, guard dog
businesses, or for experimentation purposes.
No offspring shall be sold with breeding privileges unless they are
of show quality. Companions should be
sold with a spay/neuter agreement and with no breeding privileges on the AKC
registration papers.

If Client should ever desire to
sell or place this Akita, Seller
shall have the right of first refusal.
Client shall offer said Akita
to Seller at a price equal to, or less than that at which it will be sold to
the general public. Seller shall be
given 15 business days to respond, and another 15 business days to pay the
agreed upon price. Client may not sell
any Akita from which Seller is entitled to puppies or stud service unless legal
provisions are made to ensure Seller’s rights to the stud services or puppies
due, or Seller has been paid compensation of $___________ per stud service due
and $_____________per puppy due. Client
agrees to notify REDBONE AKITAS of any change in address and/or telephone
number.

Client understands and agrees
that Seller may, or have a representative visit Client’s home without giving
advance notice. If at any time Seller
determines that the terms and conditions of this agreement have not been met or
that the animal is not receiving proper and humane care, Client must relinquish
ownership and signed over registration papers without monetary refund in whole
or part. Seller will take custody of
said Akita through any means
available.

Client agrees and understands
that he/she is solely responsible for this Akita
and to indemnify and hold harmless REDBONE AKITAS from any and all claims of
liability for the conduct of this Akita
on or after the date of this contract.

Client agrees to use the kennel
prefix REDBONE followed by name in registration of this Akita
with the AKC. Client also agrees to include Seller’s
kennel name, first and last name, e-mail address and telephone number in any
and all paid advertisements client may place to promote said Akita.

Client must agree and understand
that violation of this contract damages the goodwill and reputation of REDBONE
AKITAS and the Akita breed in
general. All the terms and conditions of
this contract should be adhered to.
Seller may/will impose a $1,000.00 non-compliance fine if this contract
is breached. This contract is formed and
shall be governed by the laws of the State of Michigan,
and jurisdiction to resolve disputes rests solely in a court of competent
jurisdiction in Michigan. Any legal action Client brings against Seller
must take place in Seller’s county of residence.
